Attorney General of Massachusetts Sues Companies Over Illegal and Unsafe Asbestos Work in Everett, Revere, and Braintree

Posted by Michael Throneberry | Sep 04, 2021

The AG of Massachusetts Maura Healey recently sued an Everett construction company over illegal and unsafe asbestos work on water mains in Everette and Braintree. Along with the Everett construction company, the Attorney General also sued other companies that failed to do their work efficiently. According to the Attorney General's office, Everett and Braintree officials hired GTA Co., Inc. to complete water main replacement projects. As part of the projects, GTA Co. Inc. and its president removed and demolished asbestos-contaminated municipal water pipes without complying with the state's Clean Air Act. Additionally, according to the AG's lawsuit, GTA Co. Inc. and its president left exposed asbestos-contaminated debris in Braintree along Sheppard Avenue and in Everett along Marlboro and Cabot streets, where they also allegedly disposed of asbestos-contaminated waste. The AG's lawsuit further claims that GTA Co. Inc. and its president defied the State's False Claims Act by lying about complying with environmental and contractual requirements.

When it comes to the other companies that the Attorney General sued, it is alleged that EZ Disposal & Recycling of Boston, and EZ Disposal Service of Revere, failed to do their work efficiently while working with the Everett construction company. These companies allegedly did not safely store and contain the asbestos-contaminated waste while on transit to Revere for disposal. Apart from that, EZ Disposal & Recycling of Boston, and EZ Disposal Service of Revere and the owners of the disposal facility, are said to have illegally and unsafely stored the asbestos-contaminated waste at the Revere facility in violation of the state's Clean Air Act.

Attorney General Maura Healey's office has for a long time made asbestos safety a priority. Because of that, the AG assured the public that her office would hold every person and company that violates the laws put in place to protect the public from asbestos exposure accountable. In her statement, Attorney General Maura Healey stated that the defendants, in this case, endangered the health of their workers and the public at risk by conducting unsafe and illegal asbestos work in the middle of city streets.

Asbestos is a naturally occurring and highly toxic mineral that was long ago mainly used in the construction industry. When asbestos is disturbed, asbestos fibers get released into the air. When a person inhales asbestos fibers, they may develop serious illnesses like mesothelioma and asbestosis. Mesothelioma is a rare and fatal type of cancer that usually develops in the thin layer of tissue that covers the majority of a person's internal organs before spreading to other organs in the body. Unfortunately, mesothelioma still has only treatment methods that help control the symptoms but no known cure. On the other hand, asbestosis is a serious, progressive, and long-term chronic lung disease that develops when a person inhales asbestos fibers and has no known effective treatment.
